Terms & conditions
Expedition Enduro (hereinafter referred to as “the Company”) accepts clients, and any accompanying 4x4 passengers (hereinafter referred to collectively as “the Client”) subject to the following conditions:
1. Booking and Payments
The deposit paid at the time of booking is accepted as part of the total tour cost and is non-refundable unless a place cannot be offered to the applicant. The remaining balance must be paid in full no later than eight weeks before the tour start date.
2. Cancellation
Cancellation charges on balance payments are as follows:
7–8 weeks before departure: 50% refund
4–7 weeks before departure: 40% refund
2–4 weeks before departure: 25% refund
0–2 weeks before departure: No refund
3. The Client Must
Hold a full motorcycle driving license throughout the tour.
Disclose any endorsements or restrictions on their driving license to the Company.
4. Recognition
Only clients recognised and accepted by the Company are permitted to drive the motorcycle.
5. Embargoed
If the motorcycle is retained or embargoed due to the Client’s actions, all associated costs, including any losses to the Company while the motorcycle is immobilized, will be borne by the Client.
6. Traffic Infractions
All fines, judicial costs, etc., arising from any traffic infractions or other violations involving the motorcycle, the Company, or the Client, caused by the Client during the tour, will be the Client’s responsibility, except when caused by the Company.
7. Insurance and Participation
The Company reserves the right to refuse the Client’s participation if the Company’s insurance provider deems the Client uninsurable.
8. Equipment Deposit
When using the Company’s motorcycle or equipment, the Client agrees to pay a deposit of €700 before the tour begins. This deposit will be refunded in full provided no damage has occurred to the motorcycle or GPS. The damage deposit should be paid in cash, either in euros, dollars, or pounds.
9. Damage Due to Wheelies
If damage occurs due to performing a wheelie, the Client will be responsible for covering the full cost of all damages.
10. Post-Tour Damage Assessment
If it’s not possible to check the motorcycle at the end of the tour, the Company will have up to seven days to notify the Client of any damages and associated costs.
11. Client Acknowledgment
The Client is responsible for securing their own personal insurance, including repatriation.
The Client acknowledges the inherent risks and dangers of the tour and agrees to travel at their own risk.
The Company, its agents, or any assisting personnel are not liable for any personal loss, injury, accident, damage, delay, or inconvenience caused by the Company, its agents, or events beyond its control (e.g., strikes, civil unrest, mechanical failure, weather conditions, etc.).
Due to the nature of the tour, the Company accepts no responsibility for any damage, loss, or accident involving the Client’s vehicle or property, whether owned, rented, or borrowed.
If the Client voluntarily leaves the tour before completion, or is required to do so by a Company representative, the Company’s liability ceases immediately, and the Company is not responsible for repatriation or any other expenses the Client incurs as a result.
In the event of an accident rendering the motorcycle undriveable, or if the Client cannot continue the tour, any costs incurred to return the motorcycle to the Company’s base will be borne by the Client (110€ to 350€).
The Client agrees to follow the authority and decisions of the Company and its representatives.
12. Tour Changes and Cancellations
The Company reserves the right to alter or cancel all or part of the tour without prior notice. If a tour is canceled, any payments received will be refunded in full.
13. Compliance with Local Laws
The Client must strictly adhere to the laws and customs of all countries visited, including those related to health, immigration, currency exchange, drugs, and other matters.
14. Itinerary Information
All distances and information in our itineraries are approximate and subject to change. While we strive to adhere to the planned itinerary, adjustments may be necessary due to weather conditions or accommodation availability.
15. Dispute Resolution
Any disputes between the Client and the Company will be handled under the jurisdiction of the country where the Company is registered. Costs incurred by the Company (including legal fees) to recover monies owed by the Client under this contract will be payable by the Client.
16. Terms and Conditions Changes
The Company reserves the right to alter or amend these Terms & Conditions without prior notice.
Client Responsibility
The Client is responsible for any damage caused due to negligence in operating the motorcycle. Participants acknowledge the risks and dangers involved in motorcycle touring and accept full liability. They are also responsible for any damage caused to third parties and agree to waive all claims against Expedition Enduro and its employees for any personal damages during the tour. Complaints must be reported immediately to the tour guide and cannot be addressed later. Expedition Enduro is not liable for delays caused by breakdowns or necessary repairs during the tour. Disputes will be settled before a competent court of law in Morocco.
Conduct
Expedition Enduro and its representatives reserve the right to disqualify any participant whose actions impede the trip or the rights, welfare, or enjoyment of other participants. Refunds are generally not provided in these cases. If a refund is granted, it will not exceed the cost of unused services.
Alcohol & Illegal Drug Policy
Clients must not arrive for the tour intoxicated or impaired. Alcohol and illegal drug consumption during a day tour is prohibited. For tours lasting two days or more, Clients must refrain from excessive alcohol consumption and avoid illegal drugs. Clients should inform Expedition Enduro staff of any prescribed medication they are taking or may need during the tour.
Tour Price Includes:
The tour price includes the rental of one motorcycle, fuel, hotel accommodations (typically double occupancy), meals, local airport transfers (in Ouarzazate and Marrakech), use of an assistance vehicle and mechanic, and third-party insurance.
Tour Price Does Not Include:
The tour price excludes airfare, riding gear, alcohol, snacks, room service charges, activities not included in the itinerary, pre-and-post tour hotel accommodations, personal items, passport and visa fees, fines, gratuities, laundry, phone/fax calls, medical or repatriation insurance, optional tours, and travel to/from Expedition Enduro premises and sightseeing excursions.
Personal Insurance:
Local insurance does not cover rider injury, medical bills, or repatriation costs due to an accident. Clients must obtain additional insurance at their own expense, covering cancellation/interruption, personal accident, health, medical care, hospitalization, repatriation, property loss, etc. Clients may be refused access to Expedition Enduro equipment if they do not present proof of such insurance at the tour’s start.
Verbal Arrangements:
Any verbal changes to the terms and conditions between you and Expedition Enduro are only valid if confirmed in writing by Expedition Enduro.
Weather Conditions
Expedition Enduro schedules tours at times when the weather in the touring area is generally favorable for motorcycling. However, the weather can change suddenly and dramatically. Expedition Enduro is not liable for unfavorable weather conditions, and no refunds are issued for such conditions. We reserve the right to modify the route as necessary to improve the tour quality or ensure client comfort and well-being.
Rider Requirements:
Riders must be at least 18 years old and hold an unrestricted motorcycle license for unlimited capacity motorcycles in their country of residence. All local traffic laws must be followed. The tour leader will brief riders on local speed limits, signage, and other regulations. Riders are responsible for adhering to all traffic rules. Helmets are mandatory at all times. Riders must adjust their riding to account for weather, road conditions, and other road users. They acknowledge the inherent risks of motorcycling, accept these risks, and take responsibility for keeping their motorcycle under control, selecting appropriate speeds, and following the country’s traffic laws. Riders are solely responsible for their riding style and speed selection, even when following a tour guide in convoy formation. Riders, their heirs, successors, and assigns agree to release, indemnify, and hold Expedition Enduro, its agents, contractors, and employees harmless from any liability or claims related to their participation in a tour.
Photographic and Film Records:
Expedition Enduro reserves the right to take photographs or film records during any trip and use them for promotional, sales, brochures, or other commercial purposes.
Damage Policy
As part of the rental fee, Expedition Enduro provides one motorcycle per client. If the motorcycle is damaged due to an accident or negligent use and becomes unusable, the Client will be required to return to Expedition Enduro’s premises in Marrakech or Ouarzazate via public transportation at their own expense. A replacement motorcycle will not be provided. Expedition Enduro is not responsible for these costs. The Client agrees to cover all costs incurred due to damage to the motorcycle and riding gear caused by accidents, negligence, or careless riding. The cost of damage will be assessed and deducted from the Client’s deposit. The value of damaged parts or gear will be determined based on the price listed on www.bikebandit.com or www.foxracing.com, plus a 30% fee for shipping and customs.
Medical & Health Advice:
Clients with existing medical conditions must inform Expedition Enduro before the tour starts, as clients may be in remote areas of Morocco during the trip. In some cases, evacuation could be prolonged, difficult, expensive, or impossible, so clients should exercise special care. If feeling unwell, clients should inform the staff so that evacuation arrangements can be made if necessary. Hospital facilities in Morocco are of good quality.
